Terms & Conditions — Gymuu

Effective date: August 1, 2025

Gymuu ("Gymuu", "we", "us", "our") provides a website, mobile apps, and partner-gym access features (the "Services"). These Terms & Conditions ("Terms") govern your access to and use of the Services. By using the Services, you agree to these Terms.

1) Definitions

  • Platform: Gymuu's website, app(s), and related digital services.
  • Membership: A paid subscription or pass that enables access to participating partner gyms/studios and features in the Platform.
  • Partner(s): Independent gyms, coaches, and studios listed on Gymuu.
  • You / User: Anyone who creates an account or uses the Services.

2) Eligibility & Account

  • You must be 18+ (or have guardian consent where permitted) to create an account and purchase a Membership.
  • Provide accurate information and keep it updated. You're responsible for safeguarding your login credentials and for all activity under your account.
  • One natural person per account; sharing passes, QR codes, or access credentials is prohibited.

3) Using Gymuu & Partner Rules

  • Gymuu lists Partners and helps you discover, book, and check-in. Partners remain independent businesses and set their own rules, equipment policies, and schedules. You must comply with their posted rules and staff instructions when you visit.
  • Some activities require advance reservation and/or have daily/weekly session limits set by a Partner; if so, book through the Platform before arriving.
  • Partners may temporarily limit capacity, change hours, or close areas for maintenance, events, or law/policy compliance. Access is subject to availability.

4) Health, Safety & Assumption of Risk

  • You confirm you are fit to exercise or have consulted a medical professional before participating. Physical activity carries risks; you voluntarily assume these risks.
  • Follow staff instructions, use equipment properly, and do not attempt exercises beyond your capability.
  • Report hazards immediately to Partner staff and via Gymuu support.

5) Memberships, Passes, Pricing

  • Prices, features, and taxes are shown at checkout before you pay.
  • Auto-renewal (if enabled): Monthly memberships renew automatically at the then-current non-promotional rate unless you cancel at least 72 hours before your renewal time in-app or via support.
  • Refunds: Unless required by law, membership fees are non-refundable once a billing period starts; pro-rations are typically not available for unused time or missed sessions.
  • Promotions & trials: Promotional pricing applies only for the stated period and converts to standard rates afterward unless you cancel within the stated window.
  • Billing issues: If a charge is incorrect, contact us within 7 days for review.

6) Credits & No-Shows (if applicable)

  • If Gymuu offers credits (e.g., for certain passes), unused credits expire after 180 days from issuance unless otherwise specified.
  • Partners may set late-cancellation/no-show windows. Missing a booked session may forfeit a credit or a day of access.

7) Cancellations, Pauses & Changes

  • You can turn off auto-renew any time before the 72-hour window noted above; cancellation takes effect at the end of the current paid term.
  • Pausing (freezing) a membership may be offered for specific reasons (e.g., medical, travel) at Gymuu's discretion; proof may be required.
  • We may modify features or pricing prospectively; we'll notify you of material changes in-app/email.

8) Conduct & Prohibited Uses

You agree not to:

  • Share, resell, or transfer your access, passes, or QR codes.
  • Bypass, disable, or misuse check-in/verification systems.
  • Harass staff or members, damage property, or engage in unsafe conduct.
  • Upload unlawful, infringing, or misleading content.

Gymuu or a Partner may deny entry, suspend, or terminate access for violations, suspected fraud, non-payment, or safety concerns.

9) Third-Party Services & Partners

  • The Platform may link to third-party sites/services. Their terms and policies apply there; Gymuu isn't responsible for their acts/omissions.
  • Partner premises are operated by the Partner. Gymuu does not supervise on-site staff or control premises conditions; Gymuu provides the digital access and booking layer.

10) Payments

  • Payments are processed by third-party payment processors. Gymuu does not store full card numbers; processors may provide tokenized references.
  • If you opt into auto-renewal, you authorize recurring charges until you cancel. You can change payment methods in your account.

11) Intellectual Property

  • The Platform, trademarks, logos, and software are owned by Gymuu or its licensors.
  • User Content (e.g., photos you upload): you grant Gymuu a worldwide, non-exclusive, royalty-free license to host, display, and transmit it solely to operate and improve the Services. You represent you have rights to what you upload.

12) Disclaimers; Limitation of Liability

  • The Services are provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation or specific results.
  • To the maximum extent permitted by law, Gymuu isn't liable for (i) injuries or damages arising from activities performed at Partner premises; (ii) lost profits or indirect, incidental, special, or consequential damages; (iii) events beyond our reasonable control.
  • Cap: Gymuu's aggregate liability to you for claims arising from the Services in any 12-month period will not exceed the amounts you paid to Gymuu in that period.

13) Privacy

Your use of the Services is also governed by the Gymuu Privacy Policy available on our site/app.

14) Suspension & Termination

We may suspend or terminate access (with or without notice) for violations, suspected fraud, non-payment, or risks to safety/security. You may terminate by closing your account and/or not renewing your membership (subject to Section 5).

15) Changes to these Terms

We may update these Terms to reflect product, legal, or policy changes. We'll post the updated Terms with a new "Effective date" and, for material changes, provide in-app/email notice.

16) Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Chennai, Tamil Nadu shall have exclusive jurisdiction, except where applicable law mandates otherwise.

18) Entire Agreement; Severability

These Terms, together with any policy or feature-specific terms referenced here, constitute the entire agreement between you and Gymuu regarding the Services. If any provision is found unenforceable, the remainder will stay in effect.
